NJPSA Files Petition In Pension Case With US Supreme Court

NJPSA, in conjunction with other public sector unions, including the NJEA, filed a petition with the United States Supreme Court seeking a review of whether the New Jersey Supreme Court failed to enforce Article I, Section 10 of the U.S. Constitution when it ruled against public employees in the Burgos case last spring (NJ Supreme Court: State Not Constitutionally Mandated to Make Pension Payment, June 9, 2015).

Late last week, a similar petition was filed by another public employee union. It is likely that the petitions will be considered together. Unfortunately a timeline for when the Court will decide whether to take up the case is not yet available.

NJPSA will keep you advised of future developments on this critical issue, including potential next steps on the legal and advocacy fronts.
